BY VISITING VITALVET.ORG, YOU ARE CONSENTING TO THE FOLLOWING TERMS AND CONDITIONS

General Terms

By using vitalvet.org (the "Site"), all visitors, referred to as “user”, “you” and “your” are bound by these Terms and Conditions. The terms “we”, “us”, and “our” refer to Vital Vet, LLC (the “Company”), owner of vitalvet.org (the “Site”).  

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY.  BY CLICKING TO AGREE OR ACCEPT THESE TERMS AND CONDITIONS WHEN PROMPTED OR ACCESSING THE SITE AND/OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS INCLUDING THE PRIVACY POLICY, COMMUNITY CONDUCT AND ETIQUETTE, AND DISCLAIMER REFERENCED BELOW. IF YOU ARE NOT ELIGIBLE OR DO NOT AGREE TO THE TERMS AND CONDITIONS, THEN YOU DO NOT HAVE PERMISSION TO ACCESS THE SITE OR USE THE SERVICES.

We reserve the right to change these Terms and Conditions or to impose new terms or conditions on use of the Site, in which case we will post the revised Terms and Conditions on this Site.  By continuing to use the Site after we post any such changes, you accept the new Terms and Conditions with the modifications.

Age Restriction 

With the exception of the Teleconsultation services, the Site is offered and open to any user eighteen (18) years of age or older provided that the user has the requisite power and authority to enter into the Terms and Conditions as specified on the Site.  The Teleconsultation services and their contents are offered to users who are twenty-one (21) years of age or older.  By using the Teleconsultation Program of the Site, you represent and warrant that they are of legal age (at least 21 years old) and have the requisite power and authority to meet all of the foregoing eligibility requirements.

The Site hosts materials that may contain information related to veterinary medicine, veterinary care, pet care, and pet lifestyle. Futhermore, the information contained on the Site, including products, resources, articles, information, videos, and Teleconsultation services (“Site Content”), provide general information and education.  ALL Site content is intended for informational use only and is not intended nor implied to be a substitute for veterinary medical care given by a licensed, veterinary healthcare professional. The Site does not provide any veterinary medical diagnostics or prognostics. Nothing contained on the Site or sent via email from Company employees, staff, and owners is considered “veterinary medical advice” nor should it be construed as veterinary medical advice or care.  No Veterinary-Client-Patient Relationship (VCPR) is created through your use of the Site or through your purchase of any of its products or services.  The Company cannot guarantee the outcome of products, services and/or recommendations available through the Site.  Users accept personal responsibility for utilizing the information contained on the Site and acknowledge that the Site Content may be erroneous, that there are no guarantees in the use of Site Content.  Users agree to verify any information, resources, and/links obtained from the Site prior to taking any action, and verify the purchase or use of any Site Content with their veterinary medical professional. 

To use the Site, you may be required to provide information about yourself including your name, email address, and other personal information.  You agree that any registration information you give to the Company will always be accurate, correct, and up to date.  You must not impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorized purpose. You must not, in the use of the Site, violate any laws in your jurisdiction.

The Site offers links to products and services from various other companies, which supply their own policies.  In the event of purchase of service, product, or program from another company, you will also be subject to the terms of the agreement set by the company providing that service, product, or program, which shall prevail in the event of a conflict. 

Returns and Refunds

For Teleconsultation services that are not performed or remain unclaimed for more than 30 days, the User will be refunded in full (minus administrative fee of $6.95).  No other refunds or returns are offered for these services.

For certain products and services available for purchase on the Site, the Company may provide returns and/or refunds.  Return and refund policies for products and services differ so please review the policy associated with the chosen product or service prior to purchase.

The Site offers links to products and services from various other companies, which offer their own policies on returns and refunds.  Please check their policies prior to purchase.  The Company is not responsible for refunds, returns, or other policies instituted by other companies.

If you have a dispute concerning any payment transaction, please contact our Support department at: contact@vitalvet.org. We reserve the right to dispute any Chargeback and take all reasonable action to authorize the transaction. 

Intellectual Property Use and Rights

You are granted a non-exclusive, non-transferable, revocable, and individual right to access and use the Site strictly in accordance with these Terms and Conditions.  Use of the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site is strictly prohibited.

The Site contains intellectual property owned by the Company including, without limitation, trademarks, copyrights, proprietary information and other intellectual property as well as the VitalVet, LLC, logo, slogan, tag lines, and all related names, designs, text, graphics, software, other files, and the selection and arrangement thereof.  The Site also contains information and designs from other companies, affiliates, and partners (“Suppliers”), and this material is governs by each Suppliers’ Terms. 

The Site is protected by the United States and international copyright and trademark laws. All Company original Site content is the property of the Company or its Suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.   As such, you agree not to modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works from, distribute, display, reproduce, or perform in any way exploit any of the content and format, in whole or in part, found on the Site or any of the resources available for download from the Site without prior written consent from the Company. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.  The Company reserves the right to immediately remove you from the Site, without refund, if you are caught violating this intellectual property policy. 

Use of protected content is solely for individual User use, and you will make no other use of the content without the express written permission of the Company and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of the Company or our licensors except as expressly authorized by these Terms.  Upon access of our Site or Content, you agree that you will not copy, duplicate, or otherwise utilize such content.  Any use contradictory to these Terms will be considered theft, and the Company reserves the right to prosecute to the full extent of the law.

Any request for written permission to use Content should be made to info@vitalvet.org. You must receive written permission prior to utilizing any Content from this Site and agree that you will not modify, copy, reproduce, sell, or distribute any Content in any manner or medium without permission.

Suppliers’ names, logos, product and service names, designs and slogans on the Site are the trademarks of their respective owners.  Permission to use or refer to such items must be granted by the respective owner(s). 

The Site makes no representations whatsoever about any other website, link, product, or service that you may access through this Site. When you access a non-vitalvet.org site, please understand that it is independent of the Site, and that the Company has no control over the content on that website. In addition, a link to a non-vitalvet.org website does not mean that the Company endorses or accepts any responsibility for the content or the use of the linked site. Accessing any of the third-party site linked to this Site is entirely at your own risk.

DISCLAIMER AND LIMITATION OF LIABILITY

Please read this Disclaimer carefully before using the Site.  This Disclaimer, including the Community Conduct and Etiquette, Privacy Policy, Terms and Conditions stated above govern the use of this Site. By using the Site, purchasing programs, products, or services from the Site, or by clicking to accept or agree to the Terms and Conditions when this option is made available, you accept and agree to be bound to this Disclaimer and its terms herein. 

Site Purpose and Guarantee

The information contained on the Site, including products, resources, articles, information, videos, and Teleconsultation services (“Site Content”), provide general information and education.  No Site Content is intended to be used as a veterinary medical advice nor should it replace or be used as a substitute for veterinary medical care.

To the best of its ability, The Company has reviewed and selected Site Content that it deems useful and informational to veterinary medical professionals, pet professionals, and pet parents.  The Site is a public resource of general information and resources that is intended, but not guaranteed, to be correct, complete, and current.  Though the Company carefully reviews all Site Content, periodically updates Site Content, and takes reasonable steps to ensure the authenticity of its Site Content, the company makes no representation or warranty that the information provided, regardless of its source is accurate, complete, reliable, current or error-free. The Company disclaims all liability for any inaccuracy, error or incompleteness in the Content. 

The Company does not make any guarantees about the results of using its Site Content, including the use of Teleconsultation services.  Users accept personal responsibility for utilizing the information contained on the Site and acknowledge the Site Content may be erroneous, that there are no guarantees in the use of Site Content.  Users agree to verify any information, resources, and/links obtained from the Site prior to taking any action, and verify the purchase or use of any Site Content with their veterinary medical professional. 

Reviews, Recommendations, Testimonials

At the Company’s discretion, the Site provides reviews and recommendations (including “Vital Tips”) of products, services (including Teleconsultation), information, and resources.  These reviews and recommendations are carefully labeled as authored by the Company and constitute the professional and good-faith opinions of the Company employees, staff, and owners.  The Site also includes reviews and testimonials by users of the Site.  These reviews and testimonials are its respective authors opinions and are not intended to guarantee current or future users the same or similar outcomes or satisfaction. 

Affiliate & Associate Programs

From time to time, the Company participates in affiliate/associate marketing programs and, as such, includes related links.  Affiliate/associate programs can include products, services, advertisements, and educational materials (including books, vdeo/dvd, online courses and webinars). Please be advised that clicking on an affiliate/associate link or purchasing an affiliate/associate-related product or service may generate income for the Company. 

The Company holds a strict policy that it will only provide affiliate/associate links to products, services, advertisements, and educational materials that it believes will provide value to our users, clients, followers, and customers. 

Company Terms

The Company reserves the right to put any account on hold or permanently disable accounts without notice due to breach of Community Conduct and Etiquette or Terms and Conditions or due to any illegal or inappropriate use of the Site or services.

The Company may make changes to its Community Conduct and Etiquette, Terms and Conditions, Disclaimer and Limitation of Liability, and/or Privacy Policy from time to time and without notice. When these changes are made, they will automatically appear on the corresponding agreements.  By continuing to use the Site thereafter, you accept and agree to these changes.

The Company reserves the right to remove or change the Site and any of its services, products, resources, and/or materials at  any time and without notice. From time to time, access to some parts or all of the Site may be restricted to users, including registered users.  The Company is not liable if for any reason all or any part of the Site is unavailable at any time or for any period. 

Arbitration

You hereby expressly waive any and all claims you may have, now or in the future, arising out of or relating to the Site, the Company, any and all contracts you enter into with the Company, and any and all of the Company’s products and services. 

To the extent that you attempt to assert any such claim, you hereby expressly agree to present such claim only through binding arbitration to occur in Hunterdon County, New Jersey, USA. You further agree to and do hereby waive any right to class arbitration and agree, instead, to conduct an arbitration related solely to any individual claims you and/or any entity related to you asserts against the Company. To the fullest extent permissible by law, you further agree that you shall be responsible for all costs associated with initiating the arbitration and for the administration of the arbitration, including arbitration fees incurred by the Company if the outcome is in favor of the Company.

International Users

All services offered by the Site are controlled, operated, and administered by the Company from our offices within the United States.  If you access the Site services from a location outside the United States, you are responsible for compliance with all local laws. You agree that you will not use the Company Content accessed through the Site in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorneys’ fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. The Company reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with the Company in asserting any available defenses.

Termination And Access Restriction

The Company reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, and you hereby consent to resolve any and all disputes arising under or related to this Site or the Terms of Service pursuant to the Arbitration (clause above). Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

No Guarantees

Users of the Site accept and understand that no guarantees are made through use of the Site or its products, services, or information. THE COMPANY MAKES NO GUARANTEES OR WARRANTIES REGARDING THE PERFORMANCE OR OPERATION OF THE SITE. THE COMPANY FURTHER MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE INFORMATION, CONTENTS, MATERIALS, DOCUMENTS, PROGRAMS, PRODUCTS, BOOKS, OR SERVICES INCLUDED ON OR THROUGH  THE SITE. TO THE FULLEST EXTENT PERMISSIBLE UNDER THE LAW, THE COMPANY DISCLAIMS ALL GUARANTEES AND WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Entire Agreement​, Waiver, Heading

These Terms and Conditions, Community Conduct and Etiquette, and Privacy Policy constitute the entire agreement between the user and the Company pertaining to the Site and its services, and supersedes all prior and existing agreements, representations, and understandings between us. No waiver of any of the provisions of this Agreement by the Company shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by the Company. 

Limitation of Liability

To the fullest extent permitted by law, the Company excludes any liability for any direct, indirect, or consequential loss or damage incurred by in connection with the Site, programs, products, or services. Neither the Company nor any of its employees, staff, or owners shall be held liable or responsible for any errors or omissions on the Site or for any damage suffered by the user or their pet as a result of using Site Content without first seeking and confirming its use with the user’s veterinary medical professional. 

YOU AGREE TO ABSOLVE THE COMPANY OF ANY AND ALL LIABILITY OR LOSS THAT YOU OR ANY PERSON OR ENTITY ASSOCIATED WITH YOU MAY SUFFER OR INCUR AS A RESULT OF USE OF THE SITE AND SITE CONTENT.  YOU AGREE THAT THE COMPANY SHALL NOT BE LIABLE TO YOU FOR ANY TYPE OF DAMAGES, INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EQUITABLE, OR CONSEQUENTIAL LOSS OR DAMAGES FOR USE OF THIS WEBSITE. By using the Site or purchasing Site Contents, you agree to this limitation of liability and release Vital Vet, LLC from any and all claims.
